Correction of Error

The Texas Department of Agriculture adopted amendments to 4 TAC §§28.2, 28.3, 28.5 and 28.7, concerning the Financial Assistance Rules, in the March 13, 2026, issue of the Texas Register (51 TexReg 1617). Due to an error by the Texas Register a portion of the text for §28.2 was omitted. The text should read as follows:

§28.2. Definitions.

In addition to the definitions set forth in Texas Agriculture Code, §58.002, as amended, the following words and terms, when used in this chapter, shall have the following meanings, unless the context clearly indicates otherwise. Definitions applicable to specific programs may be included within the applicable subchapter.

(1) Act--The Texas Agricultural Finance Act, Texas Agriculture Code, Chapter 58.

(2) Administrator--The individual employed by the Commissioner, with approval of the Board, to perform duties related to administration of the Authority, as further described in Texas Agriculture Code, Section 58.015(c).

(3) Applicant--Any eligible agricultural business filing an application with the Authority for financial assistance under any program under this chapter. A lender may submit an application on behalf of the business.

(4) Application--An application promulgated and approved by the Board, including supporting documentation and schedules as required by the Authority, for participation in a program under this chapter.

(5) Authority--The Texas Agricultural Finance Authority.

(6) Board--The board of directors of the Authority.

(7) Business day--A day on which the Department is open for business. The term shall not include Saturday, Sunday, or a traditional holiday officially observed by the State. The Department's normal business hours are 8:00 a.m. to 5:00 p.m. each business day.

(8) Compliance report--A copy of the final loan documents.

(9) Comptroller--The Texas Comptroller of Public Accounts.

(10) Current market rate--The rate of interest on a United States treasury bill or note, the maturity date of which most closely matches the maturity date of the loan, or the end of the current biennium of the State, whichever is sooner, as determined by reference to the United States treasury bill or note section of the Wall Street Journal or equivalent publication including an electronic publication, published on the day the loan is priced.

(11) Default--The failure to perform an obligation established by the loan agreement, these rules or the Act.

(12) Department--The Texas Department of Agriculture.

(13) Deputy Commissioner--The Deputy Commissioner of the Department.

(14) Equity--The applicant's contribution to a project in the form of cash, land, or other depreciable property.

(15) Fund--The Texas Agricultural Fund.

(16) Loan guarantee amount--With respect to loans made by a lender and guaranteed by the Authority, a sum measured in terms of United States dollars that the Authority pays to the lender to acquire an undivided interest in any loan or, in the case of default by the borrower, the Authority agrees to pay to the lender, not to exceed the percentage as stated in the guaranty agreement.

(17) Program--Any financial assistance program approved by the Authority board and defined by the rules under this chapter.

(18) Project--An enterprise which would further the expansion or development of production, processing, marketing or exporting of Texas agricultural products or other agricultural-related rural economic development projects.

(19) Qualified application--A completed application, including all documents and information required by the Authority and submitted by the lender or applicant for participation in a program under this chapter.

(20) Rural area--An area which is predominately rural in character; an unincorporated area or a city with a population under 50,000; or a county with a population under 200,000, or another area defined by resolution of the board with respect to a particular program.

(21) Staff--The staff of the Authority or staff of the Department performing work for the Authority.

(22) State--The State of Texas.

Certification of the Average Closing Price of Gas and Oil - March 2026

The Comptroller of Public Accounts, administering agency for the collection of the Oil Production Tax, has determined, as required by Tax Code, §202.058, that the average taxable price of oil for reporting period March 2026 is $35.95 per barrel for the three-month period beginning on December 1, 2025, and ending February 28, 2026. Therefore, pursuant to Tax Code, §202.058, oil produced during the month of March 2026, from a qualified low-producing oil lease, is not eligible for credit on the oil production tax imposed by Tax Code, Chapter 202.

The Comptroller of Public Accounts, administering agency for the collection of the Natural Gas Production Tax, has determined, as required by Tax Code, §201.059, that the average taxable price of gas for reporting period March 2026 is $1.17 per mcf for the three-month period beginning on December 1, 2025, and ending February 28, 2026. Therefore, pursuant to Tax Code, §201.059, gas produced during the month of March 2026, from a qualified low-producing well, is eligible for a 100% credit on the natural gas production tax imposed by Tax Code, Chapter 201.

The Comptroller of Public Accounts, administering agency for the collection of the Franchise Tax, has determined, as required by Tax Code, §171.1011(s), that the average closing price of West Texas Intermediate crude oil for the month of March 2026 is $91.00 per barrel. Therefore, pursuant to Tax Code, §171.1011(r), a taxable entity shall not exclude total revenue received from oil produced during the month of March 2026, from a qualified low-producing oil well.

The Comptroller of Public Accounts, administering agency for the collection of the Franchise Tax, has determined, as required by Tax Code, §171.1011(s), that the average closing price of gas for the month of March 2026 is $3.03 per MMBtu. Therefore, pursuant to Tax Code, §171.1011(r), a taxable entity shall exclude total revenue received from gas produced during the month of March 2026, from a qualified low-producing gas well.

Correction of Error

The Credit Union Department proposed amendments to 7 TAC §91.714 in the April 10, 2026, issue of the Texas Register (51 TexReg 2283). Due to an error by the Texas Register, subsection (b) of the rule was published incorrectly.

The text should read as follows:

(b) Permissible activities. Subject to the limitations of this section and §91.401 of this title (relating to Credit Union Ownership of Property), a credit union may engage in leasing activities. These activities include [becoming the legal or beneficial owner of tangible personal property or real property for the purpose of leasing such property,] obtaining an assignment of a lessor's interest in a lease of such property[,] and incurring obligations incidental to its position as the legal or beneficial owner and lessor of the leased property.

Agreed Orders

The Texas Commission on Environmental Quality (TCEQ, agency, or commission) staff is providing an opportunity for written public comment on the listed Agreed Orders (AOs) in accordance with Texas Water Code (TWC), §7.075. TWC, §7.075 requires that before the commission may approve the AOs, the commission shall allow the public an opportunity to submit written comments on the proposed AOs. TWC, §7.075 requires that notice of the proposed orders and the opportunity to comment must be published in the Texas Register no later than the 30th day before the date on which the public comment period closes, which in this case is May 26, 2026. The purpose of the hearing will be to consider the Executive Director's Preliminary Report and Petition mailed September 16, 2025 concerning assessing administrative penalties against and requiring certain actions of the City of Zavalla, for violations in Angelina County, Texas, of: Tex. Health & Safety Code §341.0315(c), Tex. Water Code §13.139(d), and 30 Texas Administrative Code §§288.20(c), 290.39(l)(5), 290.41(c)(3)(O), 290.43(c)(2) and (e), 290.45(b)(1)(D)(iii), 290.46(f)(2), (f)(3)(B)(ii), (l), (m), (m)(4), (s)(2)(C)(i), (s)(2)(B)(iv), (v), 290.111(h)(2), 290.121(a) and (b) and 291.93(3)(A).

The hearing will allow the City of Zavalla, the Executive Director, and the Commission's Public Interest Counsel to present evidence on whether a violation has occurred, whether an administrative penalty should be assessed, and the amount of such penalty, if any. The first convened session of the hearing will be to establish jurisdiction, afford the City of Zavalla, the Executive Director of the Commission, and the Commission's Public Interest Counsel an opportunity to negotiate and to establish a discovery and procedural schedule for an evidentiary hearing. Unless agreed to by all parties in attendance at the preliminary hearing, an evidentiary hearing will not be held on the date of this preliminary hearing. Upon failure of the City of Zavalla to appear at the preliminary hearing or evidentiary hearing, the factual allegations in the notice will be deemed admitted as true, and the relief sought in the notice of hearing may be granted by default. The specific allegations included in the notice are those set forth in the Executive Director's Preliminary Report and Petition, attached hereto and incorporated herein for all purposes. The City of Zavalla, the Executive Director of the Commission, and the Commission's Public Interest Counsel are the only designated parties to this proceeding.

Correction of Error

In the March 13, 2026, issue of the Texas Register (51 TexReg 1704), the Texas Commission on Environmental Quality (TCEQ or commission) adopted amendments to 30 Texas Administrative Code §§331.19, 331.107, and 331.108.

Due to a publication error by TCEQ, there were some typos throughout. There were also typographical errors from the Texas Register that resulted in the character à being included throughout the text that can be disregarded.

On page 1705, in the second paragraph TCEQ published that the date the executive director commission determines the new or amended PAA application to be administratively complete. This should only reference the executive director, not the commission. The correct paragraph should read:

"The commission adopts the amendment to §331.108 by adding new §331.108(a)(4), which establishes that an application for a PAA is not subject to an opportunity for a contested case hearing if the Notice of Receipt of Application and Intent to Obtain Permit is provided to the individual land owners, mineral rights owners and an applicable Groundwater Conservation District not later than 30 days after the date the executive director determines the new or amended PAA application to be administratively complete."

Additionally, on page 1705 on the bottom of the page under the Takings Impact Assessment, TCEQ included an extra "and" when referencing "certain aquifer and storage and recovery projects". This should read "certain aquifer storage and recovery projects"

Notice issued April 9, 2026 TCEQ Internal Control No. D-01262026-032: Yvonne Irvine Newman and Lawrence Mark Irvine, trustees and trust protectors of the Angela E. Irvine Irrevocable Trust dated February 12, 2024, and any amendments thereto, Yvonne Irvine Newman and Lawrence Mark Irvine, co-trustees of the Donald P. Irvine Family Trust dated August 23, 1988, and any amendments thereto, Lawrence M. Irvine, Kevin D. Newman, Yvonne I. Newman, and Columnar Holdings II, LLC, a Delaware limited liability company (Petitioners) filed a petition for creation of Flatrock Municipal Utility District (District) of Williamson County with the Texas Commission on Environmental Quality (TCEQ). The petition was filed pursuant to Article XVI, §59 of the Constitution of the State of Texas; Chapters 49 and 54 of the Texas Water Code; 30 Texas Administrative Code Chapter 293; and the procedural rules of the TCEQ. The petition states that: (1) Yvonne Irvine Newman and Lawrence Mark Irvine, trustees and trust protectors of the Angela E. Irvine Irrevocable Trust dated February 12, 2024, and any amendments thereto, Yvonne Irvine Newman and Lawrence Mark Irvine, co-trustees of the Donald P. Irvine Family Trust dated August 23, 1988, and any amendments thereto, Lawrence M. Irvine, Kevin D. Newman, and Yvonne I. Newman hold title to a majority in value of the land to be included in the proposed District; (2) there are no lienholders on the property to be included in the proposed District; (3) the proposed District will contain approximately 534.209 acres wholly located within Williamson County, Texas; and (4) none of the land within the proposed District is within the corporate limits or extraterritorial jurisdiction of any city. The petition further states that the proposed District will: (1) purchase, design, construct, acquire, maintain, own, operate, repair, improve, and extend a waterworks and sanitary sewer system for residential and commercial purposes; (2) construct, acquire, improve, extend, maintain, and operate works, improvements, facilities, plants, equipment, and appliances helpful or necessary to provide more adequate drainage for the proposed District; (3) control, abate, and amend local storm waters or other harmful excesses of water; and (4) purchase, construct, acquire, maintain, own, operate, repair, improve, and extend such additional facilities, including roads, parks and recreation facilities, systems, plants, and enterprises as shall be consistent with all of the purposes for which the proposed District is created. According to the petition, a preliminary investigation has been made to determine the cost of the project, and it is estimated by the Petitioners that the cost of said project will be approximately $162,195,000 ($137,550,000 for water, wastewater, and drainage; and $20,255,000 for roads; and $4,390,000 for park and recreational facilities).

Notice issued April 14, 2026 TCEQ Internal Control No. D-03112025-017: FNCFS Partnership, Ltd., a Texas limited partnership (Petitioner) and Allied Development, LLC, a Wyoming limited liability company (earnest money contract holder) filed a petition for creation of Brazoria County Municipal Utility District No. 98 (District) with the Texas Commission on Environmental Quality (TCEQ). The petition further states that the proposed District will: (1) purchase, construct, acquire, maintain, own, operate, repair, improve, and extend a waterworks and sanitary sewer system for residential and commercial purposes; (2) construct, acquire, improve, extend, maintain, and operate works, improvements, facilities, plants, equipment, and appliances helpful or necessary to provide more adequate drainage for the proposed District; (3) control, abate, and amend local storm waters or other harmful excesses of water; and (4) purchase, construct, acquire, improve, maintain and operate such additional facilities, including roads, parks and recreation facilities, systems, plants, and enterprises as shall be consonant with all of the purposes for which the proposed District is created. According to the petition, a preliminary investigation has been made to determine the cost of the project, and it is estimated by the Petitioners that the cost of said project will be approximately $61,186,000 ($38,925,000 for water, wastewater, and drainage plus $6,024,000 for recreation plus $16,237,000 for roads).

The Texas Commission on Environmental Quality (TCEQ or commission) staff is providing an opportunity for written public comment on the listed Agreed Order (AO) in accordance with Texas Water Code (TWC), §7.075. Hearing. The Texas Health and Human Services Commission (HHSC) will conduct a public hearing on May 26, 2026, at 9:00 a.m. CDT to receive public comments on the proposed interim Medicaid payment rates for State Veterans Nursing Homes.

Proposal. HHSC proposes the interim rates determined by the Veterans Land Board (VLB) for the State Veterans Nursing Homes. The proposed interim rates account for actual and projected cost increases to operate these facilities. The proposed rate will be effective retroactive to September 1, 2025.

Methodology and Justification. HHSC maintains the interim rates program so Medicaid-eligible veterans can reside in State Veterans Nursing Homes. Ten homes are currently in operation and overseen by the VLB. To better align with the 1 Texas Administrative Code (TAC) Section 355.111, HHSC performed rate-setting functions and provided rate recommendations to the VLB. The interim rate is determined by the VLB and adopted by HHSC. The VLB's determined rates can be viewed on the VLB Costs webpage at glo.texas.gov/veterans/Texas-state-veterans-homes, within Important Links "Cost Breakdown." The VLB is authorized to operate these nursing facilities under Chapter 164, Natural Resources Code.

Rate Hearing Packet. A briefing packet describing the proposed payment rates will be made available no later than May 12, 2026, at https://pfd.hhs.texas.gov/rate-packets. Notice of Public Comment Period and Public Hearings on the Draft 2027 Low Income Home Energy Assistance Program State Plan

In accordance with the U. S. Department of Health and Human Services' requirement for the Low-Income Home Energy Assistance Program (LIHEAP) and Texas Government Code, Chapter 2105, Subchapter B, the Texas Department of Housing and Community Affairs (TDHCA) is opening a public comment period and conducting four public hearings to solicit comments on the Draft 2027 LIHEAP State Plan.

The Draft 2027 LIHEAP State Plan describes the proposed use and distribution of LIHEAP funds for 2027. LIHEAP provides funding for the Comprehensive Energy Assistance Program (CEAP) and the Weatherization Assistance Program (WAP).

The Draft 2027 LIHEAP State Plan was presented and approved by the TDHCA Board of Directors on April 9, 2026. As part of the public information, consultation, and public hearing requirements for LIHEAP, the Community Affairs Division of TDHCA has posted the proposed Plan on the TDHCA website.

Air Conditioning and Refrigeration Penalties and Sanctions

The Texas Commission of Licensing and Regulation (Commission) provides this public notice that at their regularly scheduled meeting held March 24, 2026, the Commission adopted the Texas Department of Licensing and Regulation's (Department) revised enforcement plan, which was established in compliance with Texas Occupations Code §51.302(c).

The enforcement plan gives all license holders notice of the specific ranges of penalties and license sanctions that apply to specific alleged violations of the statutes and rules enforced by the Department. The enforcement plan also presents the criteria that are considered by the Department's Enforcement staff in determining the amount of a proposed administrative penalty or the magnitude of a proposed sanction. The enforcement plan is revised to include the penalty matrix for the Air Conditioning and Refrigeration program.

The penalty matrix for the Air Conditioning and Refrigeration program was last updated on July 15, 2019. Revisions to the matrix include: (1) incorporating continuing education violations and (2) other cleanup to ensure correct rule and law citations and plain language.

The Air Conditioning and Refrigeration Advisory Board recommended approval of the penalty matrix at their meeting held on February 10, 2026. The penalty matrix was presented to the Commission on March 24, 2026, and was adopted as recommended.

Request for Qualifications (RFQ) Professional Engineering Services for Regional Water Planning Group - Area B

1.0 GENERAL INFORMATION

Senate Bill 1 (SB 1), passed by the 75th Texas Legislature, mandated that the Texas Water Development Board (TWDB) implement a statewide water planning program to ensure that the water needs of all Texans are met over the next 50 years. In response to this legislation, TWDB adopted state and regional water planning rules, delineated the state into sixteen regional areas, and selected the initial members for the Regional Water Planning Group serving in each area.

The Regional Water Planning Group - Area B (RWPG-B or Group) has been designated as Region B and consists of all or parts of the following eleven (11) Texas counties: Archer, Baylor, Clay, Cottle, Foard, Hardeman, King, Montague, Wichita, Wilbarger, and a portion of Young County that encompasses the City of Olney.

The RWPG-B is responsible for preparing and adopting a regional water plan for its area and for hiring a consultant to assist with its development, which includes the engineering, hydrological, environmental, legal, and institutional components. The planning process begins with the collection and analysis of many types of information related to regional water supplies and the demands placed on them by area users. The Group decides how future water needs may be met and includes information in their water plan data about water supplies and demand, water quality problems affecting the water supply, and the social and economic characteristics of the region. The plan will also identify water supply threats to agriculture and natural resources. Information on current drought preparations and the status of other water plans in the region will also be reviewed during plan development. In addition, the plan prioritizes water management strategies based on factors such as strategy cost, year of need, and the amount of water the strategy provides.

Before the plan can be finalized, the RWPG-B must provide for public input in the planning process, hold public meetings, and furnish a draft report of the plan for public review and comment. The water plan must address the needs of all water users and suppliers in their region (except certain political subdivisions that decide not to participate). Once this process is complete, the final adopted plan will be forwarded to TWDB for approval and incorporation into a comprehensive state water plan.

2.0 SOLICITATION

The Red River Authority of Texas (the Authority), on behalf of the RWPG-B, is soliciting Statements of Qualifications (SOQs) from engineering/planning firms qualified to provide professional consulting services for Regional Water Planning activities. The Authority is the administrative entity for the RWPG-B, and as such, will be the contracting party on behalf of the Group. The SOQ should be submitted in accordance with the instructions listed in ITEM 7 below.

3.0 SCOPE OF WORK

The RWPG-B has not approved a complete Scope of Work (SOW) for the preparation of its Seventh Cycle Regional Water Plan. However, general guidance documents related to the planning effort will be posted to the Texas Water Development Board Website at the following link:

4.0 CONSULTANT SELECTION PROCESS

Members of the RWPG-B Technical Advisory Committee (TAC) will meet to analyze and evaluate each SOQ received. The TAC will create a ranked list and present it and its recommendation to the RWPG-B at the public meeting scheduled for May 27, 2026. The RWPG-B will then review, discuss, and make their selection. Once the consultant team is selected, contract negotiations to perform the professional services necessary for the development and adoption of the Region B Regional Water Plan will commence.

Public information: All information, documentation, and other materials submitted in response to this solicitation are considered non-confidential and/or non-proprietary and are subject to public disclosure under the Texas Public Information Act after the solicitation has been completed and the contract executed with the selected firm. Firms associating with other firms in order to bring specific expertise and experience to the project are allowed and encouraged.

5.0 REQUIREMENTS FOR SOQ

Respondents shall carefully read the information in the following evaluation criteria and submit a complete SOQ that addresses all questions and is in the format provided below:

5.1 Ability to provide services

5.1.1 Provide the following information:

- Legal name of firm, Form 1295, and current W-9.

- Location, size, and description of the firm and services offered.

- Contact person(s).

- Date of firm formation.

- Legal business description (i.e., Individual, Partnership, Corporation, Joint Venture, etc.).

- Evidence of being licensed to provide professional and consulting services in the state of Texas.

5.2 Qualifications and Availability: The respondent must provide a:

5.2.1 Statement of interest for the project, including a narrative describing the firm's specific expertise and unique qualifications as they pertain to TWDB regional water planning.

5.2.2 Statement regarding the availability and commitment of the firm, its principal(s), and assigned professionals to undertake the project.

5.2.3 Statement that the firm is familiar with the state of Texas rules regarding regional water planning and regional water planning grant assistance as adopted by TWDB.

5.3 Staffing Capabilities: The respondent must provide:

5.3.1 An organizational chart listing all personnel (including consultants) who will be assigned to work on this project.

5.3.2 Names and roles of key project team members who will perform the assigned tasks.

5.3.3 Résumés for all key project team members. Identify any members who have had previous experience on similar projects.

5.5.2 A description of the internal project review process and quality assurance program that will be utilized by the project team.

5.6 History of Successful Performance: The respondent may submit:

5.6.1 Documentation showing a history of meeting TWDB regional water planning project schedules.

5.6.2 Documentation showing a history of accomplishing TWDB regional water planning services within established budget - include projected cost vs. actual cost.

5.6.3 A list of TWDB regional water planning references, to include: organization's name, point-of-contract person(s), and phone number(s).

5.6.4 A list of projects completed in the Region B planning area.

Responsiveness to RFQ - Qualifications shall be prepared simply and economically, providing a straightforward, concise description of the respondent's ability to meet the requirements of this RFQ. The public hearing is to receive public comments on the Draft 2027 State Water Plan in accordance with Texas Water Code §16.051 and 31 Texas Administrative Code §358.4(a). Relevant comments concerning the Draft 2027 State Water Plan will be accepted in person and through virtual attendance of the public hearing. If you would like to provide a public comment, please fill out the online registration form at www.twdb.texas.gov/waterplanning/swp/2027/docs/visitor-sign-in-card.pdf and send it to SWPPublicComment@twdb.texas.gov or in person by 12:00 p.m. on May 27, 2026.

Persons may also provide written comments on or before 5:00 p.m. May 29, 2026, via the following link: https://forms.office.com/r/KWcZi2dMT1. A copy of the Draft 2027 State Water Plan is available on the Board's website at http://www.twdb.texas.gov/waterplanning/swp/2027/index.asp.

After consideration of comments submitted, in accordance with this notice, the TWDB will consider adopting the 2027 State Water Plan at a regularly noticed and scheduled Texas Water Development Board meeting tentatively scheduled to be held in July 2026.
